Öz
Aim: This study was conducted to determine the attitudes of physicians working in the emergency department of a public
university hospital in Istanbul regarding crime reporting. Material and Method: Face-to-face in-depth interview method
was used in the research. The research is a qualitative research. Participants were selected by snowball method among
physicians working in the emergency department of a public hospital. In-depth interviews were held with the participants,
lasting between 30 and 45 minutes. A semi-structured question guide was used in the interviews. The interviews were audio
recorded with the permission of the participants. After the interviews, the audio recordings were deciphered. Using the
thematic analysis method, themes and subthemes were determined. Results: A total of ten physicians, six male and four
female, participated in the research. The data are organized under five main themes: the tendency to report the crime,
attitudes in case the patient does not want to be reported, approach to sexual abuse against children, the physician's
prioritization of the patient's health condition, and help from different branches. Participants tend to report crime when they
encounter it and report crime even in cases where patients do not want the crime to be reported. Participants generally report
the crime according to the patient's statement. Participants are more sensitive about crimes committed against children.
Participants prioritize protecting the patient's life and health when faced with crime. Conclusion: Participants give more
importance to reporting the crime and do not take the issue of professional secrecy into consideration. Although the
participants showed sensitive approaches to basic professional principles such as prioritizing the patient's health and
protecting their life when reporting the crime, they did not mention the problems that reporting the crime may bring in the
context of harm to the patient. In this context, it is important to inform physicians to be sensitive to the risks of harm to
the patient when reporting a crime. Physicians need to be informed about the content of legal regulations regarding child
sexual abuse crimes for which they have insufficient information, how these crimes are regulated within the legal framework,
and who the perpetrators and victims may be.

Öz
Amaç: Bu çalışma, İstanbul’da kamuya ait bir üniversite hastanesinin acil servisinde görev alan hekimlerin suç bildirimi
ile ilgili tutumlarının belirlenmesi amacıyla yapılmıştır. Gereç ve Yöntem: Yöntem-Gereç: Araştırmada yüz yüze
derinlemesine görüşme yöntemi kullanılmıştır. Araştırma niteliksel bir araştırmadır. Katılımcılar, bir kamu hastanesinde
acil serviste çalışan hekimler arasından kartopu yöntemiyle seçilmiştir. Katılımcılar ile 30 ile 45 dk arasında süren
derinlemesine görüşmeler gerçekleştirilmiştir. Görüşmelerde yarı-yapılandırılmış soru rehberi kullanılmıştır. Görüşmelerde
katılımcıların izni ile ses kaydı alınmıştır. Görüşmelerden sonra ses kayıtları deşifre edilmiştir. Tematik analiz yöntemi
kullanılarak, temalar ve alt temalar belirlenmiştir. Bulgular: Araştırmaya, altısı erkek ve dördü kadın olmak üzere
toplamda on hekim katılmıştır. Veriler, suçu bildirme eğilimi, hastanın bildirim yapılmasını istememesi durumunda
tutumlar, çocuklara yönelik cinsel istismarda yaklaşım, hekimin hastanın sağlık durumunun öncelemesi ve farklı
branşlardan yardım olmak üzere beş ana tema altında düzenlenmiştir. Katılımcılar, suçla karşılaştıklarında suçu bildirme
eğilimindedir ve hastaların suçun bildirmesini istemediği durumlarda dahi suçu bildirmektedir. Katılımcılar suçun
bildirimini genellikle hastanın beyanına göre yapmaktadır. Katılımcılar çocuklara karşı işlenen suçlarda daha hassas
davranmaktadır. Katılımcılar, suçla karşılaştıklarında hastanın hayatını ve sağlığını korumaya öncelik vermektedir.
Sonuç: Katılımcılar, suç bildiriminde suçu bildirmeye daha ağırlık vermekte ve meslek sırrı konusunu hiç göz önünde
bulundurmamaktadır. Katılımcılar suçu bildirmede, hastanın sağlığını önceleme, hayatını koruma gibi temel mesleki
ilkelere duyarlı yaklaşımları gösterse de suç bildiriminin hastanın zarar görmesi bağlamında getirebileceği sorunlara
değinmemiştir. Bu bağlamda hekimlerin suçun bildiriminin hastaya zarar verme risklerine karşı duyarlı yaklaşım
göstermesi konusunda bilgilendirilmesi önemlidir. Hekimlerin yetersiz bilgiye sahip olduğu çocuğun cinsel istismarı
suçlarında yasal düzenlemelerin içeriği, yasal çerçevede bu suçların nasıl düzenlendiği, fail ve mağdurlarının kimler
olabileceği gibi konularda bilgilendirilmesi gerekmektedir.
